BACKGROUND

The UN Pacific Regional Anti-Corruption Project (UN-PRAC) is a joint initiative of UN Development Programme (UNDP) and UN Office on Drugs and Crime (UNODC), funded by the Australian Government, aimed to support Pacific Island Countries (PICs) to strengthen their national integrity systems.

The UN-PRAC project is currently in its second phase with duration of 2016-2020. It aims to help Pacific Island Countries fight corruption by (i) promoting the accession to United Nations Convention against Corruption and support Pacific States parties to actively participate in the UNCAC review process (ii) supporting PICs to strengthen national anti-corruption legislation and policies, as  well as institutional frameworks and capacities to advance their effective implementation of UNCAC (iii) providing support on the demand side of accountability, mainly through support of stronger engagement of non-government actors in the oversight of corruption, and in design of tools for more transparent service delivery.

Based on the UN Convention Against Corruption (UNCAC) and in line with Sustainable Development Goal (SDG) 16, the goal of the Project has been to strengthen measures to prevent and fight corruption more effectively and efficiently in the Pacific. UN-PRAC works with 15 countries and territories in the region namely Cook Islands, Federated States of Micronesia, Fiji, Kiribati, Marshall Islands, Nauru, Niue, Palau, Papua New Guinea, Samoa, Solomon Islands, Tonga, Tokelau, Tuvalu and Vanuatu.

Covering more than 30 percent of the Earth’s surface, the Pacific fishing industry is made up of a complex net of activities, actors and authorities. This complexity brings with it regulatory and enforcement challenges and provides numerous opportunities for criminals to break the law. Corruption strikes at the core of the fight against fisheries crime. With the fisheries production in the Pacific being an estimated value of US$3.6 billion dollars (The Commonwealth 2017), the effective regulation and crime prevention at every stage of the fisheries value chain, from the preparation of licenses and quantities of fish caught, to through to the sale of fish, among others, is crucial to get right. The Pacific relies on the fishing industry for not only financial and economic gains, but also for the well-being and livelihood of Pacific Islanders.

This is in line with UNCAC article 12, which states that “Each State Party shall take measures, in accordance with the fundamental principles of its domestic law, to prevent corruption involving the private sector, enhance accounting and auditing standards in the private sector and, where appropriate, provide effective, proportionate and dissuasive civil, administrative or criminal penalties for failure to comply with such measures”. The significance of regional cooperation to help establish a transparent and accountable governance structure in the fisheries sector is also focused on in the ‘The Framework for Pacific Regionalism ‘ (2014) and ‘Blue Pacific’ (2017) agenda. Therefore, one of the first steps includes the task of identifying the specific areas in legal and regulatory frameworks susceptible to corruption and then to address those weaknesses.

Value Chain is a collection of activities that are performed by a company to create value for its customers, and the creation of value chain leads to produce higher profitability by creating competitive advantage. Businesses have widely understood the benefits of value chain analysis to improve performance, increase profit margins, and maintain competitiveness. However, value chain analysis can be also effectively utilised for public bodies, investigators, law enforcement agencies and the private sector to identify where the risks of corruption might be generated, and how to mitigate them. In line with this perspective, this consultancy is expected to create a knowledge product that will help inform the UN-PRAC organised panel on “Building on the Blue Pacific – Integrity and Accountability in the Fisheries Industry” at the Pacific Regional Anti-Corruption Conference in Kiribati on 28-31 October 2019.

 

OBJECTIVES AND OUTPUTS

The UNDP Pacific Office is seeking the services of a Consultant to support its anti-corruption (AC) work, namely under the UN-PRAC project, implemented in partnership with the UN Office on Drugs and Crime (UNODC).

The outputs expected from this consultancy to achieve the objectives in 15 Pacific countries that UN-PRAC covers (including Cook Islands, Federated States of Micronesia, Fiji, Kiribati, Marshall Islands, Nauru, Niue, Palau, Papua New Guinea, Samoa, Solomon Islands, Tonga, Tokelau, Tuvalu and Vanuatu.) are as follows:

  1. Conduct research to identify current situation of fisheries value chain in the Pacific based on the cost, regional mandates, policy platforms, and reviews on both legislations and practices, and provide analysis upon both substantive  / potential corruption risks;
  2. Conduct comparative research on Corruption Risk Assessment methodologies in the fisheries sector at the global level for the Pacific to explore best practices; and
  3. Formulate indicatively 20 pages of report which includes the current situation of fisheries value chain, overview of comparative practices on Corruption Risk Assessment methodologies, gaps and recommendations of possible approaches to be adopted / localized in the region, as well as recommendations for feasible next steps along with an executive summary and a PowerPoint presentation reflecting on the report to be discussed at the Pacific Regional Anti-Corruption Conference.

 

DUTIES AND RESPONSIBILITIES

Scope of Work 

 

The main purpose of this assignment is the production of a knowledge product that documents and provides an analysis on the fisheries value chain and Corruption Risk Assessment in the Pacific region using provisions under Article 12 of UNCAC as a guide.

The knowledge product is expected to be published as a document that is indicatively 20 pages which will include infographics, figures and illustrations that will creatively present the findings of the assignment. The consultant would be expected to provide an analysis of current trends, perspectives and the identification of gaps that will guide discussions at the Pacific Regional Anti-Corruption Conference in Kiribati and inform the future work of UN-PRAC in the Pacific region. The consultant will also produce an executive summary of the report and a PowerPoint version reflecting on the report.

 

The tasks include, but not limited to:

 

  • Identify background information that can be used but not limited to the value chain of the fisheries sector in the Pacific, regional mandates, policy platforms, review on both legislation and practices and current situation on the topic;
  • Conduct research and gather information on the current situation of the fisheries value chain in the Pacific region and identify the possibilities of corruption;
  • Conduct research on risk assessment methodologies at the global level and explore best practices for the Pacific;
  • Determine that adoption of risk assessment methodologies might be appropriate in the Pacific context;
  • Prepare a draft report of findings with recommendations of approaches that could be utilised by government and other stakeholders in the Pacific region;
  • Provide recommendations for feasible next steps along with an executive summary and a Power Point presentation that can be discussed at the Pacific Regional Anti-Corruption Conference.

Reporting

The Consultant will be reporting to the UNDP Anti-Corruption Specialist. The Consultant is obliged to submit a final report before the finalization of the assignment, containing reflections on the performed tasks, deliverables, observations and recommendations for future steps.

 

 

Duration of the Work

The consultant will be required to work for indicative 20 days (August – September 2019).  The Terms of Reference will outline the expected outputs, and the number of days to be engaged. The outputs of the assignments will be reviewed by UN-PRAC team.

 

 

Contract Arrangement

The successful individual will sign the UNDP Individual Consultant Short Term Agreement. The engagement will be with the stated duration based on the required services.

 

Duty Station

The Consultant will be home based with required travel to selected Pacific island countries depending on the needs of the project; Since travel will be requested on Ad-hoc basis, UNDP will purchase air tickets for the Consultant based on the most direct route and cost-effective route as per UNDP Travel Guideline. UNDP will also provide Daily Subsistence Allowance (DSA) to the Consultant for the duration of his/her stay at the respective duty station at UN approved DSA rates.

 

REQUIRED SKILLS AND EXPERIENCE

Educational Qualifications

•    Minimum University Degree in Business, International Business, Economy, Fisheries, Public Policy,

      Public Administration, Social Sciences, Marine Biology or related field.

•    Science degree would be also preferred.

 

Experience & skills

  • Minimum 7 years of relevant experience in the fisheries sector / value chain / governance / anti-corruption at the national, regional or international levels is required;
  • Experience in conducting scientific research is required;
  • Good understanding of the fisheries value chain is required;
  • Proven record in advanced drafting and/or producing industry and knowledge products is required.

       

Language requirements

•      Fluency of English language is required.

EVALUATION

Evaluation Method and Criteria

Individual consultants will be evaluated based on the following methodology:

 

Cumulative analysis

The award of the contract shall be made to the individual consultant whose offer has been evaluated and determined as a) responsive/compliant/acceptable; and b) having received the highest score out of set of weighted technical criteria (70%). And financial criteria (30%). Financial score shall be computed as a ratio of the proposal being evaluated and the lowest priced proposal received by UNDP for the assignment.

 

Technical Criteria for Evaluation (Maximum 70 points)

  • Criteria A: Academic degree in Business, International Business, Economy, Fisheries, Public Administration, Public Policy, Social Sciences, Science, Marine Biology or related field; 5%
  • Criteria B: Experience in conducting scientific research; 5%
  • Criteria C: Minimum 7 years of relevant experience in the fisheries sector / value chain /  governance / anti-corruption  at the national, regional or international levels; 30%
  • Criteria D: Good understanding of the fisheries value chain;  20%
  • Criteria E: Proven record in advanced drafting and/or producing industry and knowledge products; 10%

 

Interviews maybe be conducted for the technically qualified consultants as part of the validation process.

 

Only candidates obtaining a minimum of 49 points (70% of the total technical points) would be considered for the Financial Evaluation.

 

Price Proposal and Schedule of Payments

Consultant must send a financial proposal based on daily fee which should be inclusive of his professional fee, local communication cost and insurance as reflected in Annex II. Payments will be done upon completion of the deliverables/outputs.

 

  • Consultancy involves “on demand” travel to the Pacific Island Countries which will be paid by UNDP;

The total professional fee shall be converted into a lump-sum contract and payments under the contract shall be made on submission and acceptance of deliverables under the contract in accordance with the schedule of payment linked with deliverables.

  • Technical proposal – brief description of why the individual considers him/herself as the most suitable for the assignment;
  • Financial proposal, as per template provided in Annex III.
