Description of the Assignment:

Overall objective of the consultancy is to, under supervision of the Regional Project Manager and in cooperation with the relevant UNDP project teams, conduct in-depth assessment/inception studies of the  institutional capacities of the local institutions in-charge of war crimes processing.  The consultancy shall result in an extensive Inception Report which shall properly inform further implementation of the project activities as well as establish basis for the project team for adjustment of project activities in line with the findings of the assessment.  For this purpose, the selected consultant shall undertake the following duties and responsibilities:

  • Conduct desk research of relevant legal and institutional frameworks in Bosnia and Herzegovina (BiH), Montenegro, North Macedonia, Serbia, and Kosovo regarding the work of the relevant institutions pertinent to war crimes investigations and trials and identify possible gaps and needs for harmonization with international law.  The desk research shall also consider EU accession reports (2022 Enlargement package (europa.eu) ) in the light of the individual countries’ assessments regarding the subject matter.  Furthermore, the activity shall also include in-depth review of the open-source data regarding war crimes including but not limited to publicly available reports of the national authorities, monitoring and analytical reports of relevant international organizations, as well as international and local think tanks and CSOs, especially those identified within the project document and its relevant annexes.
  • In coordination with the UNDP Project Teams, conduct in-person interviews (on-line interviews only if in-person interviews are not possible) with Delegation’s focal points on transitional justice representatives of OSCE and IRMCT, relevant beneficiaries’ institutions representatives including but not limited to courts, prosecution offices, police war crimes investigation units, witness protection services focusing on their work on war crimes in order to communicate planned activities within the project and fine-tune the activities with identified needs and challenges.
  • Coordinate activities with UNDP Consultant engaged to conduct gender analysis and ensure integration of the analysis in the Inception Report.  
  • Produce analytical report based on the research and interviews, with recommendations for further actions (legislative, institutional, capacity building, infrastructure improvement, etc.)

 *All references to Kosovo shall be understood to be in the context of the Security Council Resolution 1244 (1999).
