The United Nations Development Programme in Zimbabwe (UNDP Zimbabwe) invites proposals from qualified Firmss/NGOs to participate in the following Call for Proposals

BACKGROUND / PROJECT DESCRIPTION 

Zimbabwe aspires to be a middle-income county and society by 2030 in line with Vision 2030 and the National Development Strategy (NDS 1). The Constitution, in Section 194, provides basic values and principles governing public administration. Public administration in all tiers of government, including institutions and agencies of the State, government-controlled entities and other public enterprises must be governed by the democratic values and principles in the Constitution. The outlined principles call for a high standard of professional ethics, efficient and economic use of resources, development oriented public administration, provision of services in an impartial, fair, equitable manner without bias; accountability to Parliament and the people fostering transparency. To achieve these targets, the government set a robust agenda for economic and governance reforms. As part of the reform process, the Government has articulated public sector transformation targets for a modernized, productive and accountable public sector. Further, under section 243 of the Constitution, provision is made to protect the public against abuse of power and maladministration by State and public institutions and by officers of those institutions.

 

An efficient, responsive, transparent, and accountable public administration is central to democratic governance. Globally, UNDP’s role in Public Administration and Public Sector Reform (PSR) focuses on open government and decentralisation using a human rights-based approach. Drawing on UNDP’s comparative advantage and at the request of the Government of Zimbabwe, UNDP has been supporting initiatives on public sector reform dating back to the implementation of the findings of 1987 Kavran Public Sector Review Commission. As part of support towards evidence-based decision making in all aspects of the project, UNDP is seeking the services of a team of consultants to gather, collate and establish a database with laws, policies, cases and cabinet decisions that have an impact on public sector reform.The database will form part of the baseline to determine what different actors are doing in this area, what opportunities exist for public sector reform in light of the devolution agenda.

SCOPE OF THE WORK

Within the Public Sector Transformation programming framework, UNDP seeks the services of an NGO to gather data on Zimbabwe’s national laws, key policies, judicial decisions, Cabinet decisions, administrative decisions and relevant academic literature on governance issues and develop a searchable database for use by multiple stakeholders supporting the Government of Zimbabwe’s public sector reform initiative.  

SPECIFIC OBJECTIVES

In pursuit of the general objective to provide a baseline on laws, policies, case law, cabinet decisions that have a bearing on public sector reform, the specific terms of reference are as follows: -

  • To review existing literature,
  • Compile, collate laws, policies, cabinet updates, case-law on public administration that has a bearing on public sector reform, including issues of devolution and ICT infrastructure,
  • Incorporate the information into a database accessible for use by multiple stakeholders,
  • Provide commentary on gaps and challenges within the legislation, policies and administrative decisions which have a bearing on public sector reform.

 DELIVERABLES

The Firm/NGO is expected to produce the following deliverables:

  • Inception Report outlining understanding of the assignment, the proposed methodology to be used in undertaking the assignment as well as the timelines and stages of completion of the assignment (2 days),
  • A detailed and easily accessible relational database of information (legislation, case law, administrative decisions, parliamentary reports, Independent commission report, policies, post-cabinet briefings etc) and catalogue that provides baseline on public sector reform (10 days),
  • Detailed analysis and recommendations for public sector reform (3 days),
  • Digitised existing references and source data (qualitative/quantitative) in uniform format that can be processed by various fata analytics tools to derive insights (3 days),
  • End of activity report (2 days).

INSTITUTIONAL ARRANGEMENT / REPORTING RELATIONSHIPS  

The Firm/NGO will work under the direct supervision of assigned staff at the UNDP Zimbabwe Country Office. The Consulting team is expected to work from their own premises and liaise with UNDP in the conduct of the assignment.

For the entire period of this contract, all travel (if necessary) (within Zimbabwe) related to any contract emerging from this RFP, including all travel for consultations and discussions, meetings for planning and execution of potential works etc. will have to be borne by the firm/NGO (Contractor) and must be included in the Financial Proposal submitted. The Contractor is responsible to make all relevant travel arrangements, including hotel, transportation and other relevant costs.UNDP may, as a courtesy, facilitate through the provision of a letter of certification that travel is related to this project/contract, provide/indicate names of hotels/guest houses used by UN, but all arrangements are the responsibility of the Contractor, both financially and action‐wise.

DURATION OF THE WORK

The consultancy is expected to require an investment of approx. 20 days.

MINIMUM ORGANIZATION AND CONSULTANCY TASK FORCE REQUIREMENTS

Area of Corporate Specialization of National or Specialised Subject Consultancy Firm

           The Firm/NGO must:

  • possess at least five years of relevant experience in human rights and governance documentation,have a strong track record of quality data collection, legal analysis, report writing and project management, and,
  • have a strong track record of quality data collection, legal analysis, report writing and project management, and,
  • have strong familiarity with UN systems and procedures, management and monitoring tools is desirable.

 Team Members 

  • The development of the database and collation of information is expected to be conducted by a multi-disciplinary team,
  • The team leader should at least have a master’s degree in Human Rights Law, Gender, Public Sector Governance or a related field. A PhD will be an added advantage,
  • Requisite skill set of the team should include human rights law/administrative law/public international law/ social sciences, governance, ICT from a reputable university, and,
  • The Team members should also have at least 3-5 years of progressive experience in project management; demonstrated knowledge of data science; excellent research and analytical skills, report writing and communication skills as well as database development and management.

Experience

  • Collectively, the team should have at least 8 years of professional experience in, legal analysis, database development and management as well as public sector governance,
  • Ability to mainstream gender and previous experience with public sector institutions is an added advantage,
  • Experience making public domain information widely available in accessible formats.

Competencies

Technical Competencies

  • Strong analytical aptitude, communication, and presentation skills,
  • Strong project management skills,
  • Computer skills: Full command of Microsoft applications (word, excel, PowerPoint) and common internet applications as well as database development tools.

Personal Competencies

  • Positive, constructive attitude and approaches work with energy,
  • Result-oriented exhibiting high level of tact and diplomacy,
  • Demonstrates openness to change and ability to receive / integrate feedback,

  • Capacity to communicate fluently; excellent interpersonal and professional skills in interacting with government stakeholders and project staff,
  • Ability to work with minimum supervision.

Language and Other Skills

  • Excellent knowledge of English, including the ability to write reports clearly and concisely, and to set out a coherent argument in presentations and group interactions,
  • Working knowledge of local languages is an asset.

Important Note: The Firm/NGO is required to have the abovementioned professional and technical qualifications. Only the applicants who hold these qualifications will be shortlisted and contacted.

CRITERIA FOR SELECTING THE BEST OFFER

Firm/NGOs are expected to submit both the Technical and Financial Proposals. Accordingly, the firm/NGO will be evaluated based on Cumulative Analysis as per the following conditions:

  • Responsive / compliant / acceptable as per the Instruction to Bidders (ITB), and
  • Having received the highest score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation. In this regard, the respective weight of the proposals is:
  • Technical Criteria weight is 70%
  • Financial Criteria weight is 30%

 

RECOMMENDED PRESENTATION OF TECHNICAL PROPOSAL 

For purposes of generating proposals whose contents are uniformly presented and to facilitate their comparative review, Service Providers are required to follow the below guidelines:

Documentation Checklist

CONFIDENTIALITY AND PROPRIETARY INTERESTS

The consultants shall not either during the term or after termination of the assignment, disclose any proprietary or confidential information related to the consultancy without prior written consent. Proprietary interests on all materials and documents prepared by the consultants under the assignment shall become and remain properties of the UNDP. This assignment will be administrated by the United Nations Development Programme (UNDP), and all relevant UNDP rules, policies and procedures will apply.

Policy both parties should be aware of:

  • UNDP has a zero-tolerance policy towards sexual exploitation and abuse,
  • Members of the contracting company are not entitled to payment of overtime,
  • All remuneration must be within the contract agreement,
  • No contract may commence unless the contract is signed by both UNDP and the Contractor,
  • Where travel outside the place of assignment becomes necessary, no member of the contracting company may travel prior to contract signature,
  • Members of the contracting company will not have supervisory responsibilities or authority on UNDP budget.
