Overview :

UNDP Vietnam is seeking for 02 National Consultants to conduct a review and assessment of the performance of public non-business service providers under the management of Ministry/Department of Justice, with a focus on the performance of legal aid centers and proposing recommendations for improvement in accordance with Decree 120/2020/ND-CP on regulating the establishment, re-organization, dissolution of public administrative units.

Under the administrative reform, the government of Viet Nam has made great efforts to continuously reform institutional structure and improve the performance of public agencies. Re-structuring and improving the quality and effectiveness of the public non-business service providers are identified as a strategy component in this process. According to the Decree 120/2020/NĐ-CP dated 7 October 2020 stipulates establishment, re-organization, and dissolution of public non-business units (hereafter called Decree 120/2020-ND-CP), Ministry of Justice (MOJ) must conduct a review and assessment current network of public non-business service providers under MOJ’s management, develop a planning direction of the network of public non-business units in line with national and sub-national social economic development planning; changing the planning approaches from per each administrative units to per sector, branch, social and market demands. Accordingly, network of public non-business service providers under professional management of Departments of Justice (DOJ) and administrative management of Provincial People’s Committee needs to be reviewed, restructured, or strengthened, including notary office, asset bidding service center, state legal aid center, and other public non busines legal service providers. They are providing essential public non-business services, thus, any changes would affect to citizens.

The objectives of this assignment are:

  • To review and assess the current organizational structure and performance of the public nonbusiness service providers under management of MOJ and DOJ, with a focus on the performance of legal aid centers by the criteria set in the Decree 120/220-ND-CP
  • Based on the criteria of establishment, re-organization of the public non- busines units stipulated in Decree 120/ND-CP, review and assess the related regulations of organization and operation of the public non-busines service providers under management of MOJ and DOJ and functions of management of public non-busines service providers of MOJ’s departments.
  • Identify limitations, inadequacies, challenges, and difficulties in implementing regulations of organizations and operation of the public non- busines service providers, with a focus on the legal aid centers.
  • To propose recommendations for restructuring and strengthening the public non- business units under management of MOJ and DOJ in line with the Decree 120/2020-ND-CP, with a focus on legal aid centers; recommendations for improvement of the legal regulations of functions and responsibilities of the MOJ’s departments in charge of management of public non- busines units with an aim to enhancing quality and effectiveness of the performance of these services for the vulnerable populations.

The selection will be based on a competitive basis and will comply with UNDP procurement regulations. Interested individual consultants must submit the following documents/information (in English, PDF Format):

UNDP will not be responsible for the missing of proposal if the bidder does not follow the instructions nor send notification email to above address.
