Description of the Assignment: 

Overall objective of the consultancy is to conduct, under supervision of the Regional Project Manager and in cooperation with the UNDP Consultant in-charge of producing the Inception Report, in-depth gender analysis within the scope of the overall assessment/inception studies of the institutional capacities of the local institutions in-charge of war crimes processing and provision of support to victims and witnesses.  The consultancy shall result in a Gender Analysis Report which shall be included as an integral part of the Inception Report.  For this purpose, the selected consultant shall undertake the following duties and responsibilities:

  • Conduct desk research of relevant legal, regulatory, and institutional frameworks in Bosnia and Herzegovina (BiH), Montenegro, North Macedonia, Serbia, and Kosovo* involved in the war crimes processing, including victim and witness support, from the gender perspective.  Furthermore, conduct in-depth review of the open-source data regarding war crimes including but not limited to publicly available reports of the national authorities and relevant international organizations from the gender perspective.
  • In cooperation with the UNDP Project Team and UNDP Consultant in-charge of producing the Inception Report, as well as EU Delegation (focal point for transitional justice and gender focal points), identify key areas of intervention relevant to gender sensitization of the war crimes investigations and prosecution processes, victim support and communication about the recent past structuring relevant questions to be included in the interviews with the representatives of the beneficiaries’ institutions and civil society organizations. 
  • Prepare detailed report with concrete operational recommendations to be included as an integral part of the Inception Report to ensure there is a system in place that will facilitate inclusion of all gender relevant considerations at all stages of project implementation (related to war crimes investigations, prosecution and trial processes, victim and witness support and communication about the recent past). Provide in the report any aspects of the investigations and processing of war crimes cases and provision of support to victims and witnesses as well as communication about the recent past that can adversely affect women, contribute to gender stereotypes, increase inequality between women and men, or are contrary to international standards and best practices of gender responsive transitional justice and international criminal justice.      
  • Coordinate closely all activities with the UNDP Project Team and UNDP Consultant in-charge of producing the Inception Report to ensure due integration of the gender analysis into the final report.

* All references to Kosovo shall be understood to be in the context of the Security Council Resolution 1244 (1999).
