The South African government through the Department of Energy (DoE) in collaboration with the Department of Trade and Industry (the dti), and the United Nations Development Programme (UNDP) is implementing the project “Market Transformation through the Introduction of Energy Efficiency Standards and the Labelling of Household Appliances in South Africa”. The objectives are removing inefficient electronic appliances from the South African market and encouraging adoption of efficient technologies by implementing measures/interventions such as minimum energy performance standards (MEPS), labeling programs, and incentive programs. The overarching goal is to reduce electricity consumption and the carbon footprint of the residential sector. The Department of Energy is therefore seeking a legal adviser to deliver the following: Assessment of the SABS interpretation of the Standards Act, with the outcome of test results being made available to the DoE The legal adviser is expected to engage directly with the DoE, NRCS and SABS to gain an understanding of their position and not limit the study to a desktop review of the Acts Undertake an assessment of the two options listed in the motivation for the study, where the viability of each is evaluated and a motivated opinion is provided
Depending on which option is selected by the DoE, the legal adviser will deliver a draft of the proposed amendments to the NRCS Act OR draft new regulations under the Energy Act. |
