The access to justice machinery in India faces several challenges including case backlog, inadequate judicial strength and infrastructure leading to delays and limited access to justice, exacerbated by poor diversity in the justice system, gender justice challenges and lack of legal awareness and ineffective state sponsored legal aid delivery.
Within this context, UNDP India’s project titled Strengthening Rule of Law, Access to Justice pathways to accelerate India’s Sustainable Development aims to initiate actions and interventions for facilitating enhanced meaningful and timely access to justice for those furthest behind. Operationalizing the Leave No One Behind commitment, the project will structure its actions to combat discrimination, rising inequalities and vulnerabilities, within the justice sector, that leave people behind and undermine the potential of individuals and of humanity as a whole.
To meet these objectives, the programming will entail disaggregating data to identify who is being excluded or discriminated against within the context of accessing justice institutions and delivery, how and why, as well as who is experiencing multiple and intersecting forms of such discrimination and inequalities. The programming will focus on promoting gender equality objectives in accessing justice meaningfully, with particular emphasis on factoring the differential impact barriers to justice have on the experience of women and other gender minorities on the subject.
In order to develop a medium to long-term strategy on enhancing access to justice in India for the marginalized UNDP India plans to undertake a justice needs assessment including a people survey and stakeholder consultations using an evidence based, people-centred and human rights-based approach. UNDP’s strategies on the subject will be aligned with the priorities of the Ministry of Law and Justice and National Legal Services Authority in India.
