 PROJECT DESCRIPTION

The United Nations Development Programme in Kazakhstan (UNDP) and the National Human Rights Centre (NHRC) are implementing a project aimed at strengthening the capacity of national human rights mechanisms and promoting the implementation by the Republic of Kazakhstan of its international human rights obligations in accordance with the UN human rights conventions ratified by the state and the recommendations of the UN Treaty Bodies. As a member of the world community, Kazakhstan has acceded to more than 70 international treaties and conventions on the protection of human rights and recognized the competence of five UN committees to receive individual complaints from citizens regarding violations of their rights. In 1998, Kazakhstan acceded to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. In 2008, the Optional Protocol to the Convention was ratified, providing for the establishment of the National Preventive Mechanism against Torture (NPM), which is a mechanism for public monitoring of the protection of human rights in closed state institutions. NPM members regularly visit places of detention and other facilities under the NPM mandate and annually submit to the citizens and the Government of Kazakhstan a Consolidated Report, which describes and analyzes the human rights situation at the places visited and the response of state bodies to the recommendations of the NPM and the NPM Coordination Council. Since 2019, more than 3,000 closed children's institutions have been included in the list of institutions under the NPM mandate, which significantly increases the workload of NPM members conducting monitoring visits.

At the same time, the public of Kazakhstan notes that the comprehensive work being carried out and the measures taken by state bodies, both legal and organizational, do not lead to the expected results, as evidenced by complaints and appeals from citizens regarding torture and cruel treatment. Every year, the Ombudsman's office receives about 500 complaints about the unlawful use of force and cruel treatment. The dynamics of registration of pre-trial investigations into torture cases continues to grow (2019 - 86 crimes, 2020 - 63, 2021 - 102, 2022 - 101, 2023 - 163).

In this regard, it is necessary to continue work on the prevention of torture and other cruel, inhuman or degrading treatment or punishment. The relevant legal framework governing the fight against torture in the Republic of Kazakhstan, as well as law enforcement practice, predetermined the research carried out in this area, which is mainly related to the improvement of criminal and criminal procedural legislation.

  ОПИСАНИЕ ПРОЕКТА

Программа развития ООН в Казахстане (ПРООН) и Национальный центр по правам человека (НЦПЧ) реализуют проект, направленный на усиление потенциала национальных правозащитных механизмов и содействие исполнению Республикой Казахстан международных обязательств в области прав человека в соответствии с ратифицированными государством конвенциями ООН по правам человека и рекомендациями Договорных органов ООН.

Будучи членом мирового сообщества Казахстан присоединился к более чем 70 международным договорам и конвенциям по защите прав человека и признал компетенцию пяти комитетов ООН по приему индивидуальных обращений граждан по поводу нарушения их прав. В 1998 г. Казахстан присоединился к Конвенции против пыток и других жестоких, бесчеловечных или унижающих достоинство видов обращения и наказания. В 2008 г. был ратифицирован Факультативный протокол к Конвенции, предусматривающий создание Национального превентивного механизма против пыток (НПМ), являющийся механизмом общественного мониторинга защиты прав человека в государственных учреждениях закрытого типа. Члены НПМ регулярно посещают места содержания под стражей и другие объекты, подмандатные НПМ, и ежегодно представляют гражданам и Правительству Казахстана Консолидированный доклад, в котором описывается и анализируется ситуация с правами человека в местах посещений и ответные меры со стороны государственных органов на рекомендации НПМ и Координационного совета НПМ. C 2019 в список подмандатных НПМ учреждений включены более 3000 закрытых детских учреждений, что значительно увеличивает нагрузку на членов НПМ, проводящих мониторинговые визиты.

Вместе с тем общественность Казахстана отмечает, что проводимая комплексная работа и принимаемые государственными органами меры, как правового, так и организационного характера, не приводят к ожидаемым результатам, о чем свидетельствуют жалобы и обращения граждан по фактам пыток и жестокого обращения. Ежегодно офис Омбудсмена получает около 500 жалоб о неправомерном применении силы и жестоком обращении. Динамика регистрация досудебных расследований по делам о пытках продолжает расти (2019 год – 86 преступлений, 2020 г. – 63, 2021 г. – 102, 2022 г. – 101, 2023 г. - 163).

В этой связи необходимо продолжать работу по предупреждению пыток и других жестоких, бесчеловечных или унижающих достоинство видов обращения и наказания. Соответствующая правовая база, регламентирующая противодействие пыткам в Республике Казахстан, а также правоприменительная практика предопределила и проводимые исследования в этой сфере, которые в основном связаны с совершенствованием уголовного и уголовно-процессуального законодательства.
