Description of the Assignment:  

Objective


The overall objective of this consultancy is to provide technical support and inputs and conduct an assessment of the entire case management process of the Lao courts, both criminal and civil case management with the aim of enhancing the court system's effectiveness and accountability, particularly in the management of criminal and civil cases.


Scope of Work

The International Consultant will work with the project team, project associate, project coordinator/manager of the Court Project under the supervision of the UNDP Governance Team Leader, and work closely with UNDP programme staff and the national consultant under the same assignment. The consultant will be responsible for:

1.         Conduct an assessment to map out the case management process and identify gaps against international best practices and consultations with criminal, civil and relevant Chambers, judges, court officers at the regional and provincial levels (including area courts), prosecutors, police, lawyers, and other stakeholders that are relevant to the expected outcomes of the assignment.

2.       Conduct research on international best practices.

3.        Translate the findings into an action plan aligned with the project results framework, project goals, and stakeholders’ expectations in consultation with PSC key stakeholders.  

The consultant is expected to work closely with the PSC, regional, provincial, and area courts, the relevant partners from the justice sector and other relevant sectors, and in particular the national consultant to ensure that this consultancy delivers good outcomes. The consultant is expected to provide overarching technical expertise throughout the assessment process, ensuring alignment with international best practices and standards. They will complement the national consultant's local expertise by incorporating global perspectives and effective case management models from comparable judicial systems. Together, both consultants will collaborate on drafting the final action plan, ensuring a balanced integration of local insights and global standards. Clear roles and coordination mechanisms will be outlined in the inception note (see Task 1 below) to facilitate seamless collaboration and shared ownership of deliverables.

The tasks of the International Consultant will include:

Task 1 (10 days):  Develop the assessment framework based on international best practices and provide technical oversight

·         Design a detailed assessment methodology, including tools and approaches, and a workplan, that aligns with international best practices.

·         Provide technical oversight for the assessment, ensuring alignment with global standards and scalability. seeking the linkage to the existing UNDP initiative of the Standard Operating Procedures for Justice Sector on GBV;

·         Identify the specific challenges at each step of the case management process that require improvements.

Task 2 (2.5 days): Provide Technical Oversight and Strategic Input for Stakeholder Consultations.   

 ·         Collaborate with the National Consultant to design a structured consultation framework, ensuring alignment with international best practices and project objectives, and at all court levels (regional and provincial), prosecutors, police and lawyers, and other stakeholders that are relevant to the expected outcomes of the assignment;

·         Analyze and synthesize the consultation results to identify patterns, key stakeholder needs, and gaps in current practices.

·         Provide strategic advice on innovative, internationally tested solutions that can be adapted to enhance the effectiveness and accountability of case management systems in Lao PDR.

Task 3 (2.5 days): Research on international best practices.

·         Conduct desk research on best international practices in case management that would help enhance the effectiveness and accountability of the court’s system of Lao PDR;

 Evaluate and recommend specific international models or practices that align with the local context, identifying those that can address gaps identified during the assessment.

Task 4 (5 days): Translate the findings into an action plan aligned with the project results framework, project goals and stakeholders’ expectations. 

·         Lead the integration of desk research, international best practices, and consultation findings into a comprehensive final report that highlights key case management gaps in Lao PDR

·         Combine the findings report and desk research into a final report that outlines the key case management gaps in the Lao PDR and includes a SMART action plan (Recommendations on tools, SOPs, templates or system) to fill those gaps in alignment with the applicable project results framework;

Design a strategic roadmap for implementing the action plan, providing clear steps and timelines that align with project goals and incorporate stakeholder expectations while ensuring scalability and sustainability. 


Period of assignment/services: 20 working days.
