BACKGROUND:
UNODC Regional Office for Southeast Asia and the Pacific (ROSEAP) is hiring a legal consultant to provide technical assistance to the Drugs and Precursors section of UNODC.
The Laboratory and Scientific Service (LSS) of the United Nations Office on Drugs and Crime (UNODC) is implementing a technical cooperation project to develop and strengthen national interagency work-plans for the safe handling and disposal of seized drugs and precursor chemicals in select countries of Southeast Asia, including the Philippines. The objective of the project is to strengthen the capacity of national institutions in these countries to enable:
- Safe and cost-effective handling, transportation, storage, and final disposal of seized chemicals and chemicals, including chemical precursors used in their manufacture.
- Reducing the risk of reintroduction of seized narcotic and psychotropic drugs and chemical precursors into the illicit market, including by maximizing the use of local and regional resources and improving local capacities.
- Strengthening support for national administrative, interdictory and judicial institutions, during the seizure and in the subsequent phases of the investigation.
- The promotion of enhanced public-private partnerships, where appropriate, to support the reuse/recycling for fair use, safe handling and disposal of chemicals.
The project will develop and provide training to officials of the relevant national agencies, on safe handling and disposal methods and a menu of disposal options taking into account the national legislative and regulatory framework. As a prerequisite, an analysis of the national legislative and regulatory framework for the storage, handling and disposal of seized drugs and precursor chemicals in the Philippines is required, considering all relevant aspects of regulatory control, including the environment.
OBJECTIVES OF THE ASSIGNMENT
Under the supervision of the Scientific Affairs Officer (Crime Scene Management) based at ROSEAP, Thailand, and with substantive guidance from other LSS experts, and the overall supervision of the Regional Representative based at ROSEAP, the consultant will provide an analysis of the current national legislative and regulatory framework, capacities and other relevant information on safe handling and disposal of seized drugs and precursor chemicals used in their illicit manufacture in the Philippines.
SCOPE OF WORK
The scope of work will encompass the production of a report about relevant national laws and regulations as well as other relevant information. More specifically, the consultant will:
- Perform an analysis of the current regulations procedures and protocols on precursor chemicals used in their illicit manufacture in or seized in the Philippines.
- Identify strengths and weaknesses, gaps and opportunities in the current regulatory framework for the disposal of the seized drugs and precursor chemicals, including disposal options, which may currently not be used such as repurposing and/or public-private partnerships.
- Identify the environmental regulations, related to the disposal of hazardous materials and the emission standards/criteria that apply within the country, as well as relevant transport regulations.
- Identify name, type, and location of relevant domestic enterprises handling chemicals.
- Identify government and commercial capabilities and infrastructure relevant for the disposal of hazardous chemicals.
- Compile annual volumes of chemicals imported used for the legal purposes in the country as well as other statistical data including but not limited to amounts of drugs and precursor seized.
- Formulate recommendations to improve the regulatory framework for disposal of seized drugs and chemicals in the country where appropriate.
DURATION OF ASSIGNMENT, DUTY STATION AND EXPECTED PLACES OF TRAVEL
Maximum forty (40) workdays between 01 August 2023 and 30 October 2023. Duty station is home based in Manila, Philippines. Travel within the country is required for the assignment.

INSTITUTIONAL ARRANGEMENT
Under the supervision of the Keith Norman, Scientific Affairs Officer, the consultant is expected to constantly provide update on the progress of his/her work related to the project, to ensure that targets are met in a timely manner.
The Consultant is expected to provide his/her own laptop for the work requirement. S/he will be provided with desk space and access to office facilities and equipment. S/he will also be support by UNDP staff for administrative and logistic requirements, as necessary.
DUTY STATION AND DURATION OF WORK
Duty Station: home based. The Consultant is expected to work remotely and provide his/her own laptop, workspace, and internet connection for the work requirement. The expected duration of the assignment is The expected 40 work-days between 01 August 2023 to 30 October 2023, unless revised in a mutually agreed upon timetable between the Consultant and UNDP.
In light of the COVID-19 pandemic and declaration of State of Public Health Emergency in the Philippines, all work and travel of the Individual consultant shall be done within the guidelines and protocols set by the local and national government. Field work, trainings, meetings, and coordination shall be done in compliance with community quarantine policies.
CRITERIA FOR SELECTION OF THE BEST OFFER
The Offers received will be evaluated using a combined scoring method – where qualifications and technical proposal will be weighted 70 points and combined with the price offer which will be weighted 30 points.
The review of CV and Portfolio will be rated using the criteria in the table below. Only offerors who will obtain a minimum of 49 out of 70 obtainable points will be considered qualified and shortlisted, and eligible for evaluation of financial proposal.

SCOPE OF PRICE PROPOSAL AND SCHEDULE OF PAYMENTS
- The Contractor should send the financial proposal based on a lump-sum amount for the delivery of the outputs identified below. The total amount quoted shall be “all inclusive” (professional fees X number of person-days, communications, etc.) that could possibly be incurred by the Contractor should be factored into the final amount submitted in the proposal.
- Travel, as deemed relevant by UNDP and compliant with government guidelines on community quarantine, including per diem fees related to out-of-town trainings and workshops, will be arranged and paid for by UNDP and should not be included in the financial proposal.
- Medical/health insurance must be purchased by the individual at his/her own expense, and upon award of contract, the Contractor must be ready to submit proof of insurance valid during contract duration.
- The contract price will be fixed output-based price.
- Payments will be done upon satisfactory completion of the delivery by target due dates. Outputs will be certified by the Senior Policy Advisor prior to the release of payments.

Recommended Presentation of Offer
- Duly accomplished Letter of Confirmation of Interest and Availability using the template provided by UNDP;
- UNDP Personal History Form (P11) or Curriculum Vitae (following the template attached) indicating all past experiences from similar projects or requirements, as well as the contact details (email and telephone number) of the Candidate and at least three (3) professional references;
- Financial Proposal that indicates the all-inclusive fixed total contract price, supported by a breakdown of costs, as per template provided, and clearly stating the payment percentage as indicated in this TOR. If an Offeror is employed by an organization/company/institution, and he/she expects his/her employer to charge a management fee in the process of releasing him/her to UNDP under Reimbursable Loan Agreement (RLA), the Offeror must indicate at this point, and ensure that all such costs are duly incorporated in the financial proposal submitted to UNDP.
